General Terms and Conditions (GTC)

Article 1 – Definitions

For the purposes of these General Terms and Conditions, the following definitions shall apply:

Withdrawal Period: The period within which the Consumer may exercise their Right of Withdrawal.

Consumer: Any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession, and who enters into a distance contract with the Seller.

Day: Calendar day.

Long-term Contract: A distance contract relating to a series of products and/or services, for which the obligation of delivery and/or receipt is spread over time.

Durable Data Carrier: Any medium which enables the Consumer or Seller to store information addressed personally to them in such a way that it can be accessed for future reference and reproduced in an unchanged form.

Right of Withdrawal: The Consumer’s option to withdraw from the distance contract within the Withdrawal Period.

Seller: The natural or legal person who offers products and/or services to Consumers at a distance.

Distance Contract: A contract concluded within the framework of a system organised by the Seller for the distance selling of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the moment at which the contract is concluded.

Means of Distance Communication: Any means which, without the simultaneous physical presence of the Seller and the Consumer, may be used for the conclusion of a contract.

General Terms and Conditions: These present General Terms and Conditions of the Seller.



Article 2 – Right of Withdrawal

The Consumer has the right to withdraw from the contract within a period of 30 days without stating any reason. During the Withdrawal Period, the Consumer shall handle the product and its packaging with care.

If the Consumer exercises the Right of Withdrawal, they must return the product to the Seller, including all accessories supplied, and, if reasonably possible, in its original condition, in accordance with the reasonable instructions provided by the Seller.


Article 3 – Scope

These General Terms and Conditions apply to every offer made by the Seller and to every distance contract and order concluded between the Seller and the Consumer.

Prior to the conclusion of the distance contract, the text of these General Terms and Conditions shall be made available to the Consumer. If this is not reasonably possible, the Consumer shall be informed, prior to the conclusion of the contract, that the General Terms and Conditions are available upon request and will be provided free of charge.

If the contract is concluded electronically, the General Terms and Conditions may also be provided to the Consumer in electronic form in such a way that they can be stored by the Consumer on a durable data carrier.

If specific product or service conditions apply in addition to these General Terms and Conditions, the above paragraphs shall apply accordingly; in the event of conflicting provisions, the Consumer may always rely on the most favourable provision.

Should any provision of these General Terms and Conditions be wholly or partially invalid, the contract and the remaining provisions shall remain valid. The invalid provision shall be replaced by a provision that most closely reflects the purpose of the original.


 


Article 4 – The Offer

If an offer is limited in duration or subject to conditions, this shall be expressly stated. Offers are non-binding. The Seller reserves the right to amend the offer.

The offer shall contain a complete and accurate description of the products and/or services offered. Obvious errors or typographical mistakes shall not be binding on the Seller.

All images are for illustrative purposes only; deviations, particularly in colour, are possible.

The offer shall include clear and comprehensible information regarding the Consumer’s rights and obligations upon acceptance, in particular with respect to:

  • any applicable shipping costs,

  • the conclusion of the contract and the steps required,

  • terms of payment, delivery and performance,

  • the validity period of the offer,

  • the Right of Withdrawal,

  • options for storing the contract,

  • options for correcting input errors,

  • applicable languages,

  • relevant codes of conduct.


Article 5 – The Contract

The contract is concluded as soon as the Consumer accepts the offer and fulfils the corresponding conditions.

If the Consumer accepts the offer electronically, the Seller shall confirm receipt of the acceptance without delay. Until such confirmation has been received, the Consumer may withdraw from the contract.

The Seller shall take appropriate technical and organisational measures to secure electronic data transmission and shall provide a secure web environment.

The Seller is entitled to verify the Consumer’s creditworthiness. If there are legitimate grounds, the Seller may refuse an order or impose special conditions.

The Seller shall provide the following information to the Consumer, at the latest upon delivery, on a durable data carrier:

  • the address for submitting complaints,

  • the conditions and procedures for exercising the Right of Withdrawal,

  • warranty and customer service information,

  • the contractual terms including duration and termination options.


Article 6 – Right of Withdrawal

When purchasing products, the Consumer has 30 days to withdraw from the contract without giving any reason. The withdrawal period begins on the day after receipt of the goods.

The Consumer may only handle or use the products to the extent necessary to determine their nature, characteristics and functioning.

The withdrawal must be declared in writing or by email within 30 days. Returns must be made within a further 30 days. The Consumer bears the burden of proof for the timely dispatch of the return.

Article 7 – Costs in the Event of Withdrawal

If the Consumer exercises the Right of Withdrawal, they shall bear the direct costs of returning the goods.

Any payments already made shall be refunded no later than 30 days after receipt of the returned goods.


Article 8 – Exclusion of the Right of Withdrawal

The Right of Withdrawal may be excluded in the case of:

  • goods made to the Consumer’s specifications,

  • clearly personalised products,

  • goods that are liable to deteriorate or expire rapidly,

  • newspapers and magazines (except for subscriptions),

  • audio or video recordings or computer software where the seal has been broken,

  • hygiene products where the seal has been broken.



Article 9 – Price

During the validity period stated in the offer, prices shall not be increased, except in the event of changes to value added tax.

Price adjustments due to market conditions are permitted, provided that this has been stated in the offer.

Pricing errors (printing or typographical errors) shall not be binding on the Seller.

Article 10 – Warranty and Liability

The Seller warrants that the products conform to the contractual agreements.
Any deviations must be reported by the Consumer in writing within 30 days. Returns will only be accepted in their original condition.

The warranty corresponds to the manufacturer’s guarantee. Liability for improper handling is excluded.


 



Article 11 – Delivery and Performance

The Seller shall exercise the utmost care when receiving and executing orders. Deliveries shall be made within 30 days, unless a longer period has been expressly agreed.

In the event of a delay in delivery, the Consumer may withdraw from the contract free of charge.

The risk of loss or damage shall not pass to the Consumer until the goods have been handed over to them.


 

Article 12 – Long-term Contracts: Termination and Renewal

Contracts of indefinite duration may be terminated by the Consumer at any time, subject to a notice period of no more than one month.

Fixed-term contracts shall automatically terminate upon expiry of the agreed duration, unless a statutory extension is permitted.


Article 13 – Payment

Payments shall be due no later than 7 working days after the start of the Withdrawal Period, unless otherwise agreed.

The Consumer is obliged to immediately report any inaccuracies in the provided payment

Article 14 – Complaints Procedure

Complaints must be submitted in full and clearly described within 7 days of discovery.
A response shall be provided within 14 days. If a longer processing time is required, this shall be communicated accordingly.

Article 15 – Governing Law

Contracts between the Seller and the Consumer shall be governed exclusively by Dutch law, even if the Consumer is resident abroad.
